Terms of Service

Agreement to these terms

These terms apply to your use of the Ortho Doc Assist website, accounts, free trial, subscriptions and the Ortho Doc Assist Windows application (together, the “Service”). By using the Service you agree to these terms. If you use the Service for a clinic or hospital, you confirm that you are authorised to accept these terms on its behalf.

Who may use the Service

The Service is intended for registered medical practitioners and the staff they authorise. You must be at least 18 years old and able to enter into a binding contract.

Documentation software, not medical advice

Ortho Doc Assist is clinical documentation and workflow software. It does not diagnose patients, provide medical advice or replace professional clinical judgement.

• You are responsible for all clinical decisions and for reviewing everything you record, print or share, including dictated text, templates, prescriptions, certificates, exercise plans and discharge summaries.
• Templates and examples are starting points. Check and adapt them for each patient.
• Voice-assisted notes can contain transcription errors. Always review dictated text before saving it.

Accounts and security

Keep your login details confidential and make sure each person uses their own account. You are responsible for activity under your account and for the users you authorise. Tell us promptly at support@ortho-doc-assist.in if you suspect unauthorised access.

Free trial

New customers may use the Service free of charge for 14 days. Trials are limited to one per practice. We may change or end the trial offer at any time. At the end of the trial you need a paid subscription to keep using the Service. You will not be charged for the trial itself.

Subscriptions and payment

• Subscriptions are billed in advance, monthly or yearly depending on your plan, through our payment partner Razorpay. Prices are in Indian rupees, and applicable taxes are added.
• Subscriptions renew automatically at the end of each billing period until you cancel.
• We may change our prices. We will tell you at least 30 days before a price change affects your subscription.
• If a payment fails, we may suspend access until the payment is made.

Cancellation and refunds

You can cancel at any time. Your subscription stays active until the end of the period you have already paid for, and it will not renew. Payments are non-refundable except where required by law or where we agree otherwise in writing.

Software licence

While your trial or subscription is active, we grant you a limited, non-exclusive, non-transferable licence to install and use the Windows application on the number of computers included in your plan, for your own practice. You must not:

• copy, modify, reverse engineer or decompile the application, except as allowed by law;
• resell, rent, sublicense or share your licence outside your practice;
• work around licensing, security or usage limits.

Your data and patient information

You own the information you and your staff record in the Service, including patient information. You give us permission to process it only as needed to provide and support the Service, as described in our Privacy Policy.

You are responsible for complying with the laws that apply to your practice, including obtaining patient consent where required and keeping medical records for the periods the law requires. Where data is stored on your own computers, you are responsible for keeping backups of it.

Acceptable use

• Do not use the Service for anything unlawful or to record information you are not entitled to record.
• Do not upload malicious code or try to disrupt or gain unauthorised access to our systems.
• Do not use the Service to send spam or unsolicited messages.

Updates and availability

We may update the application and the Service to add features, fix problems or improve security. We aim to keep online services available but cannot guarantee they will be uninterrupted or error-free. Some features, such as activation, updates and account services, need an internet connection.

Intellectual property

The Service, including the software, website, templates we provide, and the Ortho Doc Assist name and logo, belongs to us or our licensors. These terms do not give you any rights to them except the licence described above.

Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose. We do not warrant that the Service or any output it produces is complete, accurate or suitable for a particular clinical situation.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to indemnify us against claims arising from your clinical practice, your breach of these terms or your violation of any law or the rights of any third party.

Suspension and termination

You may stop using the Service at any time. We may suspend or end your access if you seriously or repeatedly breach these terms, or if required by law. Where we can, we will give you notice and a reasonable opportunity to export your data.

Governing law

These terms are governed by the laws of India. Disputes will be subject to the jurisdiction of the competent courts in India.

Changes to these terms

We may update these terms from time to time. We will post the new version on this page and tell account holders about significant changes by email before they take effect.
